Legal rules SMARTEE DUO 3 Giveaway Launch

1. ORGANIZING COMPANIES

SMART PRODUCTS CONNECTION S.A., hereinafter SPC, with registered office at Parque Tecnológico de Álava, Leonardo Da Vinci 14, Miñano (Álava), with CIF No. A01042878, organizes the giveaway of an SPC SMARTEE DUO 3 smartwatch. Registered in the Mercantile Registry of Álava in volume 364, book 278, section 3, page 213, sheet 3084, entry 1.

2. OBJECTIVE AND MECHANICS OF THE GIVEAWAY

To participate and be eligible to win the prize, registration through the form available in the launch email is required. Registration is completely free. Registrations made through any other form on the website or support area will not be valid.

The organization reserves the right to invalidate entries from personal profiles suspected of being fraudulent.

You can participate multiple times, provided a valid and different email address is entered each time.

3. DURATION, SCOPE, AND METHODOLOGY

The giveaway is national in scope, subject to the prize being shipped to the Peninsula and the Balearic Islands, excluding shipments to Ceuta, Melilla, and/or the Canary Islands, but participation is not excluded. 

The giveaway will start on November 13, 2025, throughout the day and will end on Tuesday, November 18, 2025, at 23:59 hours. (Spanish peninsular time)

All individuals over 18 years old residing in Spain with their own valid email address may participate in the giveaway.

4. WINNER SELECTION

Among all entries that meet the requirements, a winner will be chosen using an external platform that allows the selection of giveaway winners such as Cooltab, Easypromos or random.org.

The winner's name will be announced on November 19, and they will be contacted via the email used to complete the registration.

Three additional alternates will be drawn. If the first selected winner cannot be contacted within 3 business days or tacitly declines, the next one will be chosen, and so on.

If none of the selected individuals can be located, the raffle will be declared null and there will be no prize beneficiaries.

5. PRIZES

The prize consists of a SMARTEE DUO 3 smartwatch valued at €44.90.

The winner can choose any color they want, if available.

Shipping will be free of charge, and the winner will not have to pay anything to receive it.

The prize cannot be exchanged for another, except in case of stock shortage at the time of the giveaway resolution. It is also not redeemable for cash nor transferable.

6. RESERVATIONS AND LIMITATIONS 

It shall be understood, by way of example but not limitation, that fraud occurs when the supposed use of applications independent of the website is detected: abuse of server queries and all behaviors that may appear abusive/malicious.

The detection of any of these practices during the raffle will result in immediate disqualification, as well as the loss of the prize if it had been awarded.

The company is exempt from any liability in the event of any error in the data provided by the winner that prevents their identification.

Similarly, the company limits its liability for damages of any kind that may be due to the temporary lack of availability or continuity of the operation of the services through which participation in the promotion takes place, particularly, but not exclusively, failures in access to the different pages and submission of participation responses via the internet.

The company also reserves the right to make changes that contribute to the successful completion of the raffle when there is just cause or force majeure reasons that prevent it from being carried out as set forth in these terms.

The company reserves the right to postpone or extend the raffle period, as well as the authority to interpret these legal terms.

Likewise, the organizing company shall be exempt from all liability if any of the cases mentioned occur, as well as from liability for damages that may be caused during the enjoyment of the prize.

The organizer's decisions regarding the interpretation of the rules will be final.

7. DATA PROTECTION

SMART PRODUCTS CONNECTION, S.A. (SPC), with CIF A01042878 and registered office at Parque Tecnológico de Álava, Leonardo Da Vinci 14, Miñano (Álava), will act as the data controller for the personal data of the participants in this giveaway.

The personal data collected (name, surname, postal address, city, email, phone, and, if applicable, others necessary for prize management) will be processed in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation - GDPR) and Organic Law 3/2018, of December 5, on Personal Data Protection and guarantee of digital rights (LOPDGDD).

Purposes of processing:

Manage participation in the draw and the delivery of the prize to the winner.
Contact the participant to inform them of the result and manage the delivery of the prize.
In case of express consent, send commercial communications by electronic or equivalent means about products, services, news, and promotions from SPC or its collaborators.

Legal basis for processing:
The processing of data is based on the participant's consent, given when registering in the draw form.

Data retention:
Personal data will be kept for the time necessary to manage the draw and, subsequently, during the legal prescription period of possible actions arising from it. If the participant has authorized the sending of commercial communications, the data will be kept until they withdraw their consent.

Data communication:
Data will not be transferred to third parties, except by legal obligation or when necessary for the management of the draw (for example, to courier companies responsible for sending the prize).

Rights of the data subject:
Participants may exercise their rights of access, rectification, deletion, opposition, restriction of processing, and portability of their data at any time, as well as withdraw their consent, by sending an email to dpd@spc.es, indicating in the subject “Data Protection – SPC Draw”.

Likewise, they may file a complaint with the Spanish Data Protection Agency (www.aepd.es) if they consider that the processing of their data does not comply with current regulations.

Participation in the draw implies knowledge and acceptance of this data protection policy.

8. ACCEPTANCE OF THE TERMS 

Simply participating in the draw implies acceptance of these Terms and Conditions, so expressing non-acceptance of all or part of them will result in the participant's exclusion and, consequently, the company will be released from fulfilling the obligation contracted with that participant.

These terms will be available on the website www.spc.es for consultation throughout the duration of the promotion.

CONTENTS AND THE QUALITY OF SERVICE

SMART PRODUCTS CONNECTION, S.A. does not assume any responsibility arising from the contents linked on the Website, provided they are external to it, nor does it guarantee the absence of viruses or other elements in them that may cause alterations in the computer system (hardware and software), in the user's documents or files, excluding any liability for damages of any kind caused to the user for this reason.

In the event that any user, client, or third party considers that the content or services provided by the linked pages are unlawful or harm the goods or rights of the user, a client, or a third party liable for compensation, and, in particular, consist of:

- Activities or contents that may be considered criminal under Spanish criminal law.

- Activities or contents that violate intellectual or industrial property rights.

SMART PRODUCTS CONNECTION, S.A. is not responsible for the lack of usefulness or suitability for a specific use of this Website. It is also not liable for any harm the User may suffer due to errors or omissions that the contents of this Website may have, although it commits to periodically verify and monitor its contents and information.
