Legal Terms for SPC ZEUS 4G PRO DRAW - SPC and @MIMODEMAMI

ORGANIZING COMPANY

SMART PRODUCTS CONNECTION S.A., hereinafter SPC, with registered office at LEONARDO DA VINCI, 14 and tax ID number A01042878, organizes the draw for one unit of the SPC ZEUS 4G PRO smartphone in collaboration with Gloria Santamaría, who will promote it on her Instagram account @mimodemami.

DISASSOCIATION FROM INSTAGRAM

INSTAGRAM does not sponsor, endorse, or manage this promotion in any way, nor is it associated with it. The user fully disassociates from INSTAGRAM and understands that, if selected as the winner, they are providing their information to SPC and not INSTAGRAM. The information provided will be used to notify the winner, deliver the prize, and allow them to enjoy it.

PURPOSE AND MECHANICS OF THE DRAW

The draw aims to promote SPC’s project and products through Gloria Santamaría’s Instagram profile (@mimodemami), who acts solely as a promoter, with SPC being fully responsible for the draw.

The organizer reserves the right to invalidate entries from personal profiles suspected of being fraudulent.

DURATION AND SCOPE

The draw is national in scope, with the prize shipment limited to the Peninsula and the Balearic Islands; shipments to Ceuta, Melilla, and/or the Canary Islands are excluded, though participation from these areas is allowed.

The draw will be launched through the @mimodemami profile in July 2022 and will end 3 days after its publication. The winner’s name will be announced on the @mimodemami profile.

REQUIREMENTS TO PARTICIPATE

Participation is open to:

All natural persons over 18 years old residing in Spain who have a genuine Instagram profile.

WINNER SELECTION

From all entries, @mimodemami will select a winner using an external platform that allows random selection among profiles that meet the requirements.

PRIZE

The prize consists of one SPC ZEUS 4G PRO smartphone, valued at €149.90.

RESERVATIONS AND LIMITATIONS

Fraud will be understood, by way of example but not limited to, as the suspected use of applications independent of the website; abuse of server queries; and any behavior that may appear abusive or malicious.

Detection of any such practices during the draw will result in immediate disqualification and loss of the prize if already awarded.

The company is exempt from any liability in case of errors in the data provided by the winner that prevent their identification.

Likewise, the company limits its liability for any damages that may arise from temporary unavailability or interruption of the services used to participate in the promotion, including but not limited to failures in accessing pages or sending participation responses via the internet.

The company also reserves the right to make changes that ensure the proper completion of the draw when justified by cause or force majeure that prevents carrying it out as stated in these terms.

The company reserves the right to postpone or extend the draw period, as well as the authority to interpret these legal terms.

Furthermore, the organizing company will be exempt from all liability if any of the above cases occur, as well as from liability for damages that may arise during the enjoyment of the prize.

DATA PROTECTION

Personal data of the winner such as name and surname, address, town, email, phone number, and other necessary information for prize delivery will be collected. The company guarantees compliance with the obligations and safeguards established by Regulation (EU) 2016/679 of the European Parliament and Council of 27 April 2016 on the protection of natural persons regarding the processing of personal data and the free movement of such data, repealing Directive 95/46/EC, Organic Law 15/1999 of 13 December on Personal Data Protection, and Royal Decree 1720/2007 of 21 December approving the regulation developing the Organic Law on Personal Data Protection.

Participation in the draw implies knowledge and acceptance of the following points by participants:

All participants agree to provide the necessary and mandatory data for the draw process, communication with the winner, and prize delivery.
Participants agree to receive commercial advertising communications via email, SMS, social communities, or any other electronic or physical means, present or future, that allow commercial communications. These communications will be sent by the organizing company and relate to its products and services or those of its collaborators or suppliers with whom it has promotional agreements.
Data will be treated confidentially and stored in an automated personal data file, with SPC as the owner and responsible party, with registered office at Álava Technology Park, Leonardo da Vinci 14 in Miñano.

ACCEPTANCE OF THE TERMS

Simply participating in the draw implies acceptance of these Terms, so expressing non-acceptance of all or part of them will result in exclusion from the draw and, consequently, the company will be released from the obligation contracted with that participant.

CONTENTS AND THE QUALITY OF SERVICE

SMART PRODUCTS CONNECTION, S.A. does not assume any responsibility arising from the contents linked on the Website, provided they are external to it, nor does it guarantee the absence of viruses or other elements in them that may cause alterations in the computer system (hardware and software), in the user's documents or files, excluding any liability for damages of any kind caused to the user for this reason.

In the event that any user, client, or third party considers that the content or services provided by the linked pages are unlawful or harm the goods or rights of the user, a client, or a third party liable for compensation, and, in particular, consist of:

- Activities or contents that may be considered criminal under Spanish criminal law.
