LEGAL BASES OF THE DRAW:

1. ORGANIZING COMPANIES

On the one hand, SMART PRODUCTS CONNECTION SA, hereinafter SPC, with registered office at LEONARDO DA VINCI, 14 with CIF nº A01042878. 

2. DISASSOCIATION WITH RESPECT TO INSTAGRAM

INSTAGRAM does not sponsor, endorse, or administer this promotion in any way, nor is it associated with it. The user completely disassociates from INSTAGRAM and is aware that, if they win, they are providing their information to SPC and not to INSTAGRAM. The information provided will be used to communicate the prize, as well as to deliver it so that they can enjoy it.  

The notification of the result will be through Instagram. 

3. OBJECTIVE AND MECHANICS OF THE DRAW

The draw aims to promote SPC products.  

To participate and be able to opt to be the winner of the prize, it will be necessary:  

• Be a follower of the brand on Instagram @spc_spain 
• Give like to the post related to the draw. 
• Follow the question or challenge mechanics related to the product mentioned in the publication.  
• Mention the requested people who must have a personal account and not a business one.
• Among the people who have answered the question correctly and meet the participation requirements, one unit of the launched product will be drawn, whose value corresponds to that shown on the website. www.spc.es  

The organization reserves the right to invalidate entries from personal profiles suspected of being fraudulent profiles.  

4. DURATION AND SCOPE

The draw is national in scope, subject to the prize being shipped to the Peninsula and the Balearic Islands, excluding shipments to Ceuta, Melilla and/or the Canary Islands, although participation is not excluded.   

The draw will last 24 hours from its publication and no more entries will be accepted after that time. The winner's name will be announced on Instagram within the next 24 business hours from the closing of entries in the draw. These deadlines may vary depending on the company's internal needs. 

3 more substitutes will be drawn. If within 3 business days the first selected participant has not been located or tacitly renounces it, the next one will be chosen, and so on. 

If it is not possible to locate any of the selected participants, the draw will be declared null and there will be no prize beneficiaries.  

Once the winner has been chosen, or the draw has been declared null for the reason mentioned above, the publication of the draw will be archived and will disappear from the brand's feed on Instagram for purely aesthetic reasons.  

5. REQUIREMENTS TO PARTICIPATE AND REQUIREMENTS TO BE A BENEFICIARY

All natural persons over 18 years old residing in Spain with a real Instagram profile may participate in the raffle.  

6. WINNER SELECTION 

Among all entries that meet the requirements, a winner will be chosen with an external platform that allows winner selection such as Easypromos, Wask or others. 

7. PRIZES

The prize varies depending on the product that has just been launched exactly 24 hours before, and its value will be the one listed on the website. www.spc.es  

Since this is a new launch, the winner will receive the contest unit once we have the stock of that product available. They will be informed at all times. 

The prize includes shipping, and the winner will not have to pay anything at all to receive it. 

9. RESERVATIONS AND LIMITATIONS 

It will be understood, by way of example but not limitation, that fraud occurs when the supposed use of applications independent of the website is detected: abuse of server queries and all behaviors that may appear abusive/malicious. 

The detection of any of these practices during the raffle will result in immediate disqualification, as well as the loss of the prize if it had been awarded. 

The company is exempt from any liability in the event of any error in the data provided by the winner that prevents their identification. 

Similarly, the company limits its liability for damages of any kind that may be due to the temporary lack of availability or continuity of the operation of the services through which participation in the promotion occurs, particularly, but not exclusively, failures in access to the different pages and sending of participation responses via the internet. 

The company also reserves the right to make changes that contribute to the successful completion of the raffle when there is just cause or force majeure reasons that prevent it from being carried out as set forth in these terms. 

The company reserves the right to postpone or extend the raffle period, as well as the authority to interpret these legal terms. 

Likewise, the organizing company shall be exempt from all liability if any of the indicated cases occur, as well as from liability for damages that may be caused during the enjoyment of the prize. 

10. DATA PROTECTION 

Personal data of the winner will be collected such as name and surname, address, city, email, phone, and other data that may be necessary for prize delivery. The company guarantees compliance with the obligations and guarantees established by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC, Organic Law 15/1999 of 13 December on the Protection of Personal Data, and Royal Decree 1720/2007 of 21 December, which approves the Regulation developing the Organic Law on the Protection of Personal Data.  

Participation in the draw implies knowledge and acceptance of the following points by the participants: 

1. All participants accept providing the necessary and mandatory data for the draw procedure, communication with the winner, and prize delivery.  
2. Participants accept receiving commercial advertising communications via email, SMS, social communities, or any other electronic or physical means, present or future, that enables commercial communications. These communications will be made by the organizing company and related to its products and services, or by its collaborators or suppliers with whom it has reached some promotional agreement. 
3. The data will be treated confidentially and stored in an automated file of personal data, with the company SPC being the owner and responsible for all files, with registered office at Parque Tecnológico de Álava, Leonardo da Vinci 14, in Miñano. 
4. The holder guarantees the possibility of canceling the data of participants who wish to do so and communicate it via email. dpd@spc.es 

11. ACCEPTANCE OF THE TERMS 

Simply participating in the draw implies acceptance of these Terms, so expressing non-acceptance of all or part of them will result in the exclusion of the participant and, consequently, the company will be released from fulfilling the obligation contracted with that participant.
